Gearbox suing 3D Realms over new Duke Nukem

Gearbox Software has filed a lawsuit against 3D Realms and Interceptor Entertainment over an alleged trademark and copyright infringement relating to the Duke Nukem intellectual property.

The latter two companies recently revealed Duke Nukem: Mass Destruction, a top down action RPG for PC and PlayStation. 

In a cease and desist letter sent to 3D Realms, Gearbox said the company is "colluding with other, equally-unauthorized parties to develop a new video game based upon the Duke Nukem IP."

Gearbox bought the Duke Nukem IP from 3D Realms in 2010, before going on to release Duke Nukem Forever, which had been in development for years. 3D Realms still owns the rights to re-release older Duke Nukem games that it developed, and last year launched 1996's Duke Nukem 3D on Steam. 

Gearbox's Steve Gibson told Polygon that they did not want to go to court, and that the action is a "formality". Mass Destruction is reportedly still going ahead, despite 3D Realms' acknowledgement of the breach.
