NRL star Jarryd Hayne has been accused of rape in a civil suit filed in California on Wednesday (NZT).

It's alleged Hayne engaged in nonconsensual sexual intercourse with a female referred to as "Ms. V" in December 2015 during his time in the U.S playing for the NFL's San Francisco 49ers, San Jose's Mercury News reports.

The same case was dismissed back in October 2016 by the District Attorney for insufficient evidence.

The complainant claims she was a virgin at the time of the incident and was afraid to initially come forward. She eventually reported it to police in May 2016, the same month Hayne announced his retirement from the NFL.

According to court documents, the woman was "heavily intoxicated" after proceeding from the 49ers game against the Cincinnati Bengals at Levi's Stadium to a San Jose bar with a group of friends. Hayne met up with the group before taking the woman back to his San Jose home in an Uber.

"Mr Hayne brought our client back to his home, approached her in the dark, turned her around as to not face him and told her 'no kissing'," attorney John Clune said in a statement provided to news.com.au.

"He then had nonconsensual sexual intercourse with her, causing her significant physical pain."

The lawsuit includes claims of sexual battery, gender violence, infliction of emotional distress and negligence.

Hayne played for the 49ers for one season and made international headlines after leaving his prolific rugby league career behind to chase his lifetime dream of playing in the NFL. 

His representative Wayne Beavis told The Daily Telegraph he he was unaware of any claims against his client.
