A male model apologised to his alleged rape victim and claimed he thought she was her roommate, according to reports.

Henry Romero, 34, has pleaded not guilty to a charge of first-degree rape after a drunken night out in New York in March.

"He went into my room thinking it was me," the alleged victim's roommate told the New York Post, after she heard her friend screaming from the other room.

"I heard her say, 'Get off me! Get off me!' And then he said, 'I'm sorry, I thought you were [your roommate]."

The two women had been out drinking with Romero that night. They became separated when he began "acting creepy", said one of the women, who had originally been Romero's date.

She returned home to find her roommate sleeping in her bed and the model asleep on the living room floor.

The woman took her friend's bed, who was visiting from another country, but was woken up a few hours later by the incident.

One of the pair has black hair and the other is blonde, making it impossible to confuse the two, she says.

Romero is free on a bond of US$3000 (NZ$4130).
