American Olympic swimmer Ryan Lochte's criminal case has been moved to a higher court after a Rio de Janeiro judge denied a bid by his lawyers to have the case dismissed.
TMZ reports a Court of Justice spokesperson said the judge moved Lochte's false police report up to the Brazilian Ministry of Justice, who will now determine a fine to charge the athlete.
The fine is expected to be greater than the US$11,000 (NZ$15,350) penalty given to Jimmy Feigan, with whom Lochte lied to police about being robbed at gunpoint.
Team USA swimmers Lochte, Fegan, Jack Conger and Gunnar Bentz were found to have drunkenly broken a soap dispenser, damaged a door, tore down a sign and urinated on the premises at a Shell service station in Rio de Janeiro.
