Man accused of attacking wife with hammer talks to Story

An Auckland man accused of attacking his wife with a hammer was let off by a District Court judge without conviction. The High Court has recently overturned that decision.

This is the latest in a line of questionable decisions by Judge Philippa Cunningham. We approached Judge Cunningham for her response, however judges are not permitted to comment on specific cases.

Mr Mohib pleaded guilty last year to three charges -- common assault, assault with a weapon and threatening behaviour.

Despite his guilty plea, he says he didn't hit Fatimah with a hammer but that's not how our courts have ruled.

He applied for discharge without conviction which he got in the District Court but later it was over turned in the high court.

Justice Wylie in the High Court said that he had doubts about Mr Mohib's insight into his offending and that it seemed to him, that he was keen to blame the victim and her family.
