battle is brewing in Dunedin between a family's popular treehouse and the council.

Trevor Oke built a treehouse for his three grandsons about three months ago at their Mosgiel home.

The boys' mother, Janice Norman-Oke, says the Dunedin City Council has told them to remove the treehouse after a neighbour called them alerting them of the structure, the Otago Daily Times reports.

The council has ruled the treehouse breaches section 17 of the Building Act 2004, which says all structures must comply with the building code.

They ordered Ms Norman-Oke to cut the treehouse down, which she says is "ridiculous" and wants to work with the council to make it compliant.

"They need to tell us what to do to stay compliant,'' she told the Otago Daily Times.

"I'm hoping they allow it to stay.''

Council building solutions principal adviser Neil McLeod said in a statement the council did not make building laws but was required to uphold them.

"The DCC doesn't go looking for issues like this, but we received a complaint about the tree house, which we were obliged to follow up."

The council has said it would be happy to help provide further clarification as to how the treehouse can be made compliant.
