Video of sex act involving 1st XV rugby players shared on social media, police 'aware'

An uncensored video of two 1st XV rugby players engaging in a sexual act has come to the attention of police after the footage was circulated on social media.

The video was recorded at a boozy celebration after 1st XV players from a South Island school defeated a rival college, according to the New Zealand Herald.

During the party, a sex act between two of the boys was allegedly filmed and later shared on social media.

A police spokesperson told Newshub authorities are "aware of the existence of the video", but no formal complaints had been received in relation to the incident. 

"We have nothing further to add," the spokesperson said.

It's unclear if anyone is being spoken to in relation to the matter.

Under the Harmful Digital Communications Act 2015, people can be charged - and even face jail time - for harm caused by any form of "text message, writing, photograph, picture, recording, or other matter that is communicated electronically", which has been "transferred, sent, posted, published, disseminated, or otherwise communicated by means of a digital communication". 

Digital communication is considered harmful when it causes "serious emotional distress".

Netsafe chief executive Martin Cocker told the Herald sharing the video could potentially result in charges under the Act. 

"I don't think it needs explaining to the majority of the population that filming something like this and sharing it online is unacceptable," Cocker told the outlet.
