Ngāti Whātua Ōrākei lodged the case in February.

Robert Armitstead walked on closed tracks three times in 2019, breaching an Auckland Council bylaw.
He was sentenced on Tuesday in the Auckland High Court.
They are also both guilty of aggravated robbery.
"When he heard other people had been charged, he knows they're the wrong people."
He was on trial at the High Court.
His body was found almost 30km north from where he disappeared.
The Crown alleges he was "intimately" involved with the offending.
