English woman trapped in 'loveless marriage' refused divorce by court

An English woman, who says she is trapped in a loveless marriage, cannot leave her husband as the court refuses to grant her a divorce. 

Tini Owens, 68, and her husband Hugh Owens, 80, have been married for 40 years. 

She wants a divorce, citing unreasonable behaviour and said their marriage has simply broken down, The Guardian reports. 

However five judges at the Supreme Court refused to grant Ms Owens a divorce, citing a joyless marriage was not adequate grounds if one spouse refused to agree. 

"The appeal of Ms Owens must be dismissed. She must remain married to Mr Owens for the time being," Supreme court judge Lord Wilson said. 

The case has thrown the country's provisions for divorce in the spotlight. 

Judge Lord Wilson said in Ms Owens case "Parliament may wish to consider whether to replace a law which denies to Mrs Owens any present entitlement to a divorce in the above circumstances."
