Disgraced businessman Ron Brierley could be freed from jail early due to his failing health.
The 84-year-old's sentence was reduced in the Supreme Court of New South Wales on Tuesday.
If granted parole, he could be freed from jail in two weeks.
The last public sighting of Brierley was three months ago.
He was frail, relying on a walking stick, and slow-moving as he entered a Sydney courthouse for sentencing. A judge jailed him for possessing 46,000 images of child abuse material.
He spent the first 14 days of his 14-month sentence in COVID isolation.
On Tuesday, another COVID lockdown in jail prevented him from attending his appeal hearing.
But his lawyer argued the rich lister's health has deteriorated.
He's been plagued by health issues, including having surgery on his leg.
At times he relies on his cellmate to help care for him and rarely showers due to fears of falling over.
His lawyer argued the 84-year-old isn't fit to be living within the "ordinary jail population".
He asked the panel of three Supreme Court judges to consider moving Brierley to the Kevin Waller Unit for frail and aged inmates.
But because Brierley can "walk around" is "self-caring and taking part in activities", he was told he hasn't "met the admission criteria".
A panel of Supreme Court judges reduced his entire sentence by four months to end in October and brought forward his non-parole period to mid-February - meaning Brierley could be released in two weeks.
Brierley was sentenced last October for storing more than 46,000 images of young girls on storage devices. He was caught with USBs in his bags while flying to Fiji on holiday.
Some images were of girls as young as four years old. Many were photographed in sexualised poses, wearing crop tops, singlets, bikinis and underwear. They were often posing in sexualised poses and sometimes photographed in a bedroom in front of a backdrop with a curtain.
