Auckland anti-masker incites 'militia' to perform citizens' arrests and 'seize' COVID-19 vaccines

The Auckland man who was ejected from a Mitre 10 for refusing to wear a face-covering is now calling on fellow New Zealanders to "do some militia shit" with him and "seize" COVID-19 vaccines.

The 35-year-old man, who in November filmed himself walking into a Helensville Mitre 10 and was later kicked out by staff for refusing to wear a mask, says he wants people to join his "liberating movement" and perform citizen's arrests.

"I've never done a citizen's arrest before, but always a first time for everything. So we need to get the papers out to the police because they need to seize the weapons, which are the vaccines," he says in his Facebook video.

"We need to seize anyone and dish them the papers and actually do some citizen's arrests."

The man says he's going to go to the police first to tell them what he plans to do, but in the meantime he is calling on others in the Helensville area, where he is based, to join him.

"I'm asking for some soldiers now, I'm not after pussy people please, I'm after some people who mean business and know what's going on."

You can perform a citizen's arrest in New Zealand under specific circumstances. The Crimes Act 1961 says everyone is justified in arresting someone without warrant if:

Any person found committing any offence against this Act which the maximum punishment is not less than 3 years' imprisonment; or

Any person found at night (9pm till 6am) committing any offence against this Act.

There are other situations where people can perform a citizen's arrest, including if they've been asked by a police officer to help arrest someone, if they believe on reasonable and probable grounds that someone has committed an offence against the Crimes Act 1961 and is fleeing or being pursued by someone they believe to be a police officer, or if they witness a breach of the peace.

People then must hand the suspect over to police at the earliest possible time.

The 35-year-old man appears to believe several conspiracy theories, including that 9/11 is "bullshit", the Earth is flat, and that world governments harvest human beings.
