Former army major, Marry-Ann Martinek, has applied to use the words 'Sam the Koala' on chocolates along with the image of firefighter David Tree giving the marsupial a drink from his water bottle.
However Mr Tree isn't having a bar of it and has slammed the move.
Sam the Koala died last week of urogenital chlamydiosis.
